Timelines are subject to weather, site conditions, and regulatory approvals. Any delays will be communicated to you promptly with as much notice as possible.
A 20% non-refundable deposit is required at the time of booking to secure your requested services, with the remaining balance due prior to project commencement or delivery.
Website Use and Intellectual Property
All content on the Website (designs, text, graphics, photos, logos, software) is owned or licensed by Lake and Pond Aquatics Ltd. Images and reviews from clients have been used with permission to do so.
You may use the Website for lawful, personal, and non-commercial purposes only.
You must not copy, distribute, or exploit Website content without our written consent.
Access to Property (For Site Works)
The Client must provide safe and reasonable access for our personnel, vehicles, and machinery.
The Client must identify all underground and overhead services (pipes, cables, drains). We accept no liability for damage to undisclosed services.
Temporary access routes or ground protection may be required; reinstatement will be agreed in advance.
Health, Safety, and Site Conditions
We comply with UK Health & Safety legislation and conduct risk assessments were necessary before work begins.
The Client must disclose known hazards, e.g. unstable ground, contaminated materials, livestock.
Only authorised personnel are permitted in active work areas.
We may suspend work if conditions are unsafe or regulatory requirements are not met.
Use of Machinery
Machinery will only be operated by our trained staff unless agreed otherwise in writing.
The Client is responsible for ensuring ground conditions are suitable for plant and vehicle access.
We are not liable for ground damage. Any reinforcements needed should be agreed before work has commenced.
Environmental Responsibilities
We take reasonable steps to minimise environmental impact.
The Client is responsible for obtaining necessary consents, permits, or licences (e.g. Environment Agency permissions, planning approvals), unless agreed otherwise.
Spoil and waste will be disposed of, spread, or removed as agreed in writing.
Client Responsibilities
The Client must:
Liability
We are not liable for delays or damages caused by weather, unforeseen ground conditions, or third-party actions.
Our liability for direct damages shall not exceed the contract value.
Payment
Payment terms are the date stated on the invoice unless otherwise agreed.
Interest may be charged on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998.
Ownership of materials remains with us until full payment is received. If payment is not received we will remove all materials as is our right.
Cancellations and Delays
Cancellations must be made in writing we would request with as much notice before scheduled works are due to commence.
We may charge for mobilisation costs or losses from late cancellations.
Works may be rescheduled in the event of unsafe conditions, adverse weather, or circumstances beyond our control.
Termination
Either party may terminate the contract in writing if:
The other party commits a material breach and fails to remedy within a reasonable time, or
Insolvency or inability to perform obligations occurs.

We are not liable for loss or damage caused by reliance on Website information.
Governing Law
